Posted Jan 1, 2019 effective for all new and existing Users. This Agreement supersedes all previous versions of the AgBuySell User Agreement.
Welcome to www.AgBuySell.com (“AgBuySell”). By using AgBuySell.com or by registering for an AgBuySell account, you expressly agree to be bound by the terms and conditions of this AgBuySell User Agreement and to the terms and conditions set out in all of our Policies posted on our website from time to time. Our Policies are designed to ensure that AgBuySell works for all of our Users [and advertisers]. We may implement amendments to this Agreement from time to time.
Interpretation:
The following terms have the following meanings on AgBuySell:
- Auction – means an Auction for the purchase and sale of Goods and/or Services using the AgBuySell website;
- AgBuySell – means www.AgBuySell.com;
- Buyer – means any person having the legal capacity to enter into a contract under the laws of Alberta, who has successfully bid on Goods or Services in an Auction. A Buyer shall not include any person whose use of AgBuySell has been terminated;
- Goods – means all Goods offered for sale by Auction on AgBuySell, including Livestock and agriculture related products;
- Livestock – includes but is not limited to cattle, horses, pigs, goats, sheep, and poultry, including Livestock products;
- Member – means any User who has registered for an AgBuySell account and has received approval of registration.
- Policies – means and includes all Policies posted on AgBuySell from time to time;
- Seller – means any person having the legal capacity to enter into a contract under the laws of Alberta, who has listed and received a bid on Goods or Services in an Auction that the Seller is prepared to accept;
- Services – means all Services offered for sale by Sellers, Truckers and other Users of AgBuySell, including without limitation Livestock transportation and delivery Services;
- User Agreement – means this agreement and all Policies posted on AgBuySell from time to time;
- Trucker – means any person offering transportation and delivery Services of Goods to or for Buyers or Sellers;
- User – means any person accessing and using our AgBuySell website;
AgBuySell offers a superior on-line forum for Users to buy and sell Livestock and other agriculture related Goods and Services. AgBuySell Ltd. is not a Livestock dealer or agent. We do not own, buy, sell, or deliver any of the Goods or Services posted on our site. Instead, we provide the on-line marketplace for Buyers and Sellers to do so directly between them.
This means that Buyers and Sellers are responsible for arranging, carrying out and enforcing all details of the transactions they make using our site, including payment, transfer, and delivery of the Goods or Services. They are responsible for doing their own due diligence, which includes investigating all applicable: licensing and registration requirements and all applicable: laws and regulations; inspecting the Goods or Services, including title/ownership, to verify they are authentic and their quality and condition and ensure they are authentic; verifying; and satisfying all applicable registration, declaration, and reporting requirements.
Your AgBuySell.com account may be accessed only by use of your User ID and password. You are solely responsible and liable for any use and misuse of your user ID and password and for all activities that occur under your User ID and password. For security reasons, you must keep your User ID and password confidential and not disclose them to any person or permit any other person to use them, except an authorized representative of AgBuySell. AgBuySell recommends that you choose a password that is unique to you and not easily guessed by others. You should change your password on a regular basis, and you must log out at the end of each session
We rely on the information you provide through this website, including registration information (name and email address), payment information (credit card numbers and expiration dates), and transaction-related information, which must be true, accurate, current and complete. You are required to update your registration information and payment information immediately, if applicable, and will be solely responsible and liable for any and all loss, damage, and additional costs that you, we or any other person may incur as a result of your submission of any false, incorrect or incomplete information. You acknowledge that you will keep your name and address current and accurate in the My Account section of the website.
In connection with using or accessing AgBuySell sites, Services, applications and tools, you will not:
- post content or items in inappropriate categories or areas on our site;
- violate any laws applicable in your Province and in Canada
- violate any third party rights or our stated Policies;
- use our sites, Services, applications or tools if you are not able to form legally binding contracts or are temporarily or indefinitely suspended from using our sites, Services, applications, or tools;
- fail to deliver payment for items purchased by you, unless, for example, the Seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot reach the Seller;
- fail to deliver items purchased from you, unless, for example, the Buyer fails to meet your terms, or you cannot reach the Buyer;
- manipulate the price of any item or interfere with any other Users' listings;
- circumvent or manipulate our fee structure, the billing process, or fees owed to AgBuySell;
- post infringing, unlawful, false, inaccurate, misleading, defamatory, obscene, or libelous content;
- take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off of the sites or using it for purposes unrelated to AgBuySell);
- circumvent any AgBuySell policy or determinations about your account status such as temporary or indefinite suspensions or other account holds, limitations or restrictions;
- transfer by any manner any AgBuySell application or your AgBuySell account (including Feedback) and account ID to another party without our consent;
- distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes;
- distribute viruses or any other technologies that may harm AgBuySell, or the interests or property of AgBuySell Users;
- reproduce, perform, display, distribute, reverse engineer, or prepare derivative works from content that belongs to or is licensed to AgBuySell, or that comes from the Services and belongs to another AgBuySell User or to a third party including works covered by any copyright, trademark, patent, or other intellectual property right, except with prior express permission of AgBuySell and/or any other party holding the right to license such use;
- commercialize any AgBuySell application or any information or software associated with such application;
- harvest or otherwise collect information about Users, including email addresses, without their consent; or
- circumvent any technical measures we use to provide our Services.
If we believe or discover that you are abusing AgBuySell in any of the ways mentioned above or otherwise, we may, in our sole discretion, take any steps to prevent and mitigate such abuse, such as limiting, suspending, or terminating your User account(s) and access to our Services, delaying or removing hosted content, removing any special status associated with your account(s), reducing or eliminating any discounts, and taking technical and legal steps to prevent you from using our Services.
We may cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue the AgBuySell sites, or Services. Additionally, we reserve the right to refuse or terminate our Services to anyone for any reason at our discretion.
You may wish to use other Services offered by AgBuySell, its advertisers, its Members or its partners, including, without limitation, AgBuySell Featured Specials. By signing up, accessing, and using AgBuySell Featured Specials, you will be eligible to receive special discounts on Promotional Items supplied by our marketing department. All of our Featured Specials will be directly related to the Cattle industry, and will offer substantial discounts from retail pricing. Any Member can 'opt-out' of receiving these notices by requesting a cancellation of this free Service.
AgBuySell and its Users work together to keep our sites, Services, applications and tools working properly AgBuySell safe. Please report problems, offensive content, and policy violations to us.
When a Buyer or Seller issue arises we may consider the User's performance history and the specific circumstances in applying our Policies. We may choose to be more lenient with policy enforcement in an effort to do the right thing for both Buyers and Sellers.
Using AgBuySell as a Bidder is generally free. We may charge fees for certain Services related to Sellers such as posting an ad, or upgrading to premium ad placements. If the product or service you elect to use charges a fee, you will be able to review and accept that charge. All of our fees are quoted in Canadian Dollars, and fees may change from time to time. We may choose to temporarily change our fees for promotional events or to feature new Services; these changes are effective when we announce the promotional event or new Service. Our fees are non-refundable, and you are responsible for paying any fees when they are due. If any fee(s) become past due, AgBuySell has the right to limit the use of any of our User or end user Services.
You agree to receive calls, including autodialed and/or pre-recorded message calls, from AgBuySell at any of the telephone numbers (including mobile telephone numbers) that we have collected for you as authorized and described in our Privacy Policy, including telephone numbers you have provided us, or that we have obtained from third parties or collected by our own efforts. If the telephone number that we have collected is a mobile telephone number, you consent to receive SMS or other text messages at that number or on that mobile device. Standard telephone minute and text charges may apply if we contact you at a mobile number or device. You agree we may contact you in the manner described above at the telephone numbers we have in our records for these purposes:
To contact you for reasons relating to your account or your use of our sites, Services, application or tools (such as to collect a debt, resolve a dispute, or to otherwise enforce our User Agreement) or as authorized by applicable law; we may do so at any of the telephone numbers we have in our records for you, including ones you have provided or that we have otherwise obtained or collected in accordance with the User Agreement and our Privacy Policy.
To contact you for marketing, promotional, or other reasons that you have either previously consented to or that you may be asked to consent to in the future; we will do so only at the telephone numbers that you have provided to us. If you do not wish to receive such communications, you can opt-out in the communications preference section of your account.
We may share your telephone numbers with our service providers (such as billing or collections companies) who we have contracted with to assist us in pursuing our rights or performing our obligations under the User Agreement, our Policies, or any other agreement we may have with you. These service providers may also contact you using autodialed or prerecorded messages calls and/or SMS or other text messages, only as authorized by us to carry out the purposes we have identified above, and not for their own purposes.
We will not share your telephone number with non-affiliated third parties for their purposes without your explicit consent, but may share your telephone numbers with Members of the AgBuySell corporate family and/or our affiliates, for their use, as authorized under our Privacy Policy. Members of the AgBuySell corporate family and/or our affiliates will only contact you using autodialed or prerecorded message calls and/or SMS or other text messages, if you have requested their Services.
You understand and agree that AgBuySell may, in its discretion, monitor or record telephone conversations you have with AgBuySell or its agents for quality control and training purposes, for its own protection or as may be required by law. You acknowledge and understand that, while your communications with AgBuySell may be overheard, monitored, or recorded, not all telephone lines or calls may be recorded by AgBuySell.
When providing us with content or causing content to be posted using our Services, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully sub licensable (through multiple tiers) right to exercise any and all copyright, trademark, publicity, and database rights and other intellectual property rights you have in the content, in any media known now or developed in the future, and to the fullest extent permitted under applicable law, you waive any and all moral rights and promise not to assert such rights or any other intellectual property or publicity rights against us, our sub licensees, or our assignees.
You represent and warrant that none of the following infringe any rights mentioned in the preceding paragraph: your provision of content to us, your causing content to be posted using the Services, and use of any such content (including of works derived from it) by us, our Users, or others in contract with us that is done in connection with the Services and in compliance with this User Agreement.
If you believe that any of your rights have been violated, please notify AgBuySell User Support and we will immediately investigate the matter. We reserve the right to remove any User and/or content where we suspect the violation of the terms of AgBuySell, or the rights of any other User, end user, or other party.
By using AgBuySell and AgBuySell.com, you agree to the collection, transfer, storage and use of your personal information on our servers located in the Canada and the United States as further described in our privacy policy.
AgBuySell doesn't sell or rent Users' personal information to third parties for their marketing purposes under any circumstances. AgBuySell may disclose personal information to respond to legal requirements, adhere to or to enforce our Policies, respond to claims that a posting or other content violates AgBuySell's or any other's rights, or protect anyone's rights, property, or safety
We are not a Livestock dealership or Livestock dealers. We do not arrange or handle payment between Users, and we do not pay any levies, fees or charges relating to transactions made between Users using our site.
You agree that you, as a Buyer, Seller or Trucker, have all necessary and applicable licenses, registrations and documentation required by law for the exchange of Goods and Services listed on AgBuySell, including under the Alberta: Livestock Identification and Commerce Act, Marketing of Agricultural Products Act, and Alberta Beef Producers Commission Regulation
We try to keep AgBuySell and its sites, Services, applications, and tools safe, secure, and functioning properly. You acknowledge that we cannot guarantee the continuous operation of or access to our sites, Services, applications or tools. You further acknowledge that operation of and access to our sites, Services, applications or tools may be interfered with as a result of technical issues or numerous factors outside of our control. Bid updates and other notification functionality in AgBuySell’s applications may not occur in real time. Such functionality is subject to delays including, without limitation, delays or latency due to your physical location or your wireless data service provider’s network. You agree that you are making use of our sites, Services, applications and tools at your own risk, and that they are being provided to you on an "AS IS" and "AS AVAILABLE" basis. Accordingly, to the extent permitted by applicable law, we exclude all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In addition, to the extent permitted by applicable law, we (including our officers, directors, agents and employees) are not liable, and you agree not to hold us responsible, for any damages or losses (including, but not limited to, loss of money, goodwill or reputation, profits, or other intangible losses or any special, indirect, or consequential damages) resulting directly or indirectly from:
- Your use of or your inability to use our sites, Services, applications and tools;
- Delays or disruptions in our sites, Services, applications or tools;
- Viruses or other malicious software obtained by accessing our sites, Services, applications or tools or any site, Services, applications or tools linked to our sites, Services, applications or tools;
- Glitches, bugs, errors, or inaccuracies of any kind in our sites, Services, applications and tools or in the information and graphics obtained from them;
- Damage to your hardware device(s) or loss of data that results from the use of our sites, Services, applications and tools;
- The content, actions, or inactions of third parties, including items listed using our sites, Services, applications or tools, feedback provided by third parties, or the destruction of allegedly fake items;
- A suspension or other action taken with respect to your account;
- The duration or manner in which your listings appear in search results as set forth in the Listing Conditions Section below;
- AgBuySell’s decision to end or remove your listing(s);
- Your need to modify practices, content, or behavior or your loss of or inability to do business, as a result of changes to this User Agreement or our Policies; AgBuySell reserves the right to modify its Policies and this User Agreement at any time consistent with the provisions outlined herein;
Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
You acknowledge that we are not a traditional auctioneer. Instead, our sites are venues to allow Users to offer, sell, and buy Cattle related product, at any time, from anywhere in Canada, in an auction-style format. We are not involved in the actual transaction between Buyers and Sellers. Any pricing or shipping guidance we provide in our sites, Services, applications, or tools is solely informational and you may choose not to follow such guidance at any time. We do not warrant or guarantee that any particular results will result from following guidance we provide (e.g. that your listing will sell, that a particular shipping option is the least expensive, etc.) While we may help facilitate the resolution of disputes, we have no control over and do not guarantee the existence, quality, safety, or legality of items advertised; the truth or accuracy of Users' content or listings; the ability of Sellers to sell items; the ability of Buyers to pay for items; or that a Buyer or Seller will actually complete a transaction or return an item.
Despite the previous paragraphs, if we are found to be liable, our liability to you or any other User, advertiser, or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.
If you have a dispute with one or more Users, you release us (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, and agents) from claims, demands, and damages (direct actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. In entering into this release you expressly waive any protections (whether statutory or otherwise) that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favor at the time of agreeing to this release
AgBuySell’s site contains information and content that is proprietary or is licensed to AgBuySell by our Users or third parties and protected by Canadian and international copyright laws. You agree that you will adhere to the following rules:
- Do not violate any laws of your Province or the Country of Canada;
- Make sure your ads are not false or misleading;
- Do not infringe any third-party right;
- Do not distribute viruses or any other technologies that may harm AgBuySell or the interests or property of AgBuySell Users;
- Do not impose an unreasonable load on our infrastructure or interfere with the operation of the AgBuySell website;
- Do not copy, modify, or distribute our web content or any other person's content;
- Do not use any robot, spider, scraper or other automated means to access AgBuySell to collect content for any purpose without our express written permission;
- Do not harvest or otherwise collect information from the AgBuySell.com website without our written consent;
- Do not bypass measures used to prevent or restrict access to AgBuySell.com and our affiliated websites;
By listing an item on AgBuySell’s site, you agree to pay AgBuySell’s fees, to assume full responsibility for the content of the listing and item offered, and to accept the following listing conditions: when you list an item on AgBuySell’s sites, your listing will be posted on AgBuySell’s sites and can be viewed in AgBuySell. Your listing may not be immediately searchable by keyword or category for several hours (or up to 24 hours in some circumstances), so AgBuySell can't guarantee exact listing durations. AgBuySell reserves the right to end your listing for any reason. Where and whether your listing appears in search and browse, results may be based on certain factors including, but not limited to, title, bidding activity, end time, keywords, feedback, and detailed Seller ratings.
Content included by you in a listing that violates any of AgBuySell’s Policies may be deleted at AgBuySell’s discretion.
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We store and process your information on computers located in Canada and/or the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing in to your account. If you object to your information being transferred or used in this way please do not use our Services.
You have read the AgBuySell Privacy Policy, the terms of which are incorporated into this User Agreement, and you agree that the terms of that policy are reasonable. You consent to the collection, use and disclosure of your personal information by AgBuySell in accordance with the terms of and for the purposes set out in the Policy.
You will indemnify and hold AgBuySell (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, and agents) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this User Agreement, your use of AgBuySell’s sites, Services, applications, or tools, and/or your violation of any law or the rights of a third party.
No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this User Agreement.

You may contact AgBuySell via phone by following the instructions listed on our customer support page. Unless stated otherwise in this User Agreement, if any of the provisions in this User Agreement shall be deemed invalid, void, or for any reason unenforceable, such provisions shall be deemed severable and shall not affect the validity and enforceability of any remaining provision. In our sole discretion, we may assign this User Agreement, by providing notice of such assignment in accordance with the Notices Section. Headings are for reference purposes only and do not limit the scope or extent of such Section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this User Agreement.
We may amend this User Agreement at any time by posting the amended terms on www.AgBuySell.com. Our right to amend the User Agreement includes the right to modify, add to, or remove terms in the User Agreement, including terms related to fees and charges. We will provide you 30 days notice by posting the amended terms. Except as stated otherwise in this User Agreement or elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. Your continued use of our Services after the effective date of these amended terms constitutes your acceptance of them. If you do not agree to the amendments, you should stop using AgBuySell and the www.AgBuySell.com site, and terminate this User Agreement by closing your AgBuySell account. This User Agreement may not be otherwise amended except in a writing hand signed by you and us. For purposes of this provision, a "writing" does not include an email message and a signature does not include an electronic signature.
Any translation of this User Agreement and all related documents is done for local requirements and in the event of a dispute between the English and French version, the English version of this User Agreement and all related documents shall govern. If you are a resident of the Province of Quebec, the following clause applies: The parties hereby confirm that they have requested that this User Agreement and all related documents be drafted in English. Les parties ont exigé que la présente convention et tous les documents auxquels cell-ci réfère soient rédigés et signés en langue anglaise.
This User Agreement (including incorporated policies and rules) sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of this User Agreement: Fees and Services, Release, Content, Limitation of Liability, Indemnity and Resolution of Disputes.
AgBuySell Ltd. and AgBuySell.com are committed to protecting the privacy of our users. We welcome you to our website and want to ensure that you are comfortable. It is our goal to help make our site a safe and secure environment.
The purpose of this privacy policy is to inform you of what kind of information we may gather about you, how we may use that information, whether we disclose it to anyone, and the choices you have regarding use of and correction of information. This privacy policy applies only to www.AgBuySell.com and not to any other company or organization’s website to which we link.
AgBuySell works hard to make sure our programs and policies meet a high standard of privacy for personal information. We do not sell or rent your personal information to third parties for their marketing purposes. We disclose your personal information only as outlined in our Privacy Policy or with your explicit consent.
We use third-party privacy certification programs like COMODO SECURE to help make sure our privacy practices are consistent with our legal obligations and industry best practices.
We use sophisticated safeguards like firewalls, encryption and Secure Socket Layers to help protect your personal information from loss, theft, and unauthorized access and disclosure.
The information we receive from you depends upon what you do when visiting our site. We collect information about you in three ways: directly from you, from web server logs, and from cookies.
User-Supplied Information: At times you may be asked to provide your name, email address, or some other personal or ad based information to become a member of the AgBuySell website, and/or to post an item for sale. The more accurate the information you volunteer, the better we are able to customize your experience. You can visit our website without registering for an account. When you decide to provide us with your personal information, you agree that we will store that information on our servers.
Server Log Information: When you visit an internet website, you disclose certain information about yourself, such as your Internet Protocol (IP) address, the time of your visit, and the referring location. Like many other sites, AgBuySell records this basic information about visits to our site.
Cookies: In order to offer and provide customized, personal service, cookies may be used to store and help track your information. For example we may use cookies to remind us who you are and to deliver content and services based on your account information.
Privacy and protection of your personal information is important to us. Any user statistics that we may provide to other Users of the AgBuySell website are in the aggregate only and do not include any personally identifiable information about any individual user. Since our website and posted ads are available to the public, you are consenting to AgBuySell's collection, use, and disclosure of your personal information and to the transfer and storage of that information on our servers currently located in Canada and the United States.
AgBuySell collects and stores the following information:
- email address, phone numbers, physical contact information, ad information pertaining to item(s) listed for sale, and (depending on the service used) sometimes financial information (including credit card and billing information);
- computer sign-on data, statistics on page views, traffic to and from AgBuySell.com and our affiliated websites, and ad data (all through cookies - you can take steps to disable the cookies on your browser although this is likely to affect your ability to use the site);
- other information, including users IP address and standard web log information.
AgBuySell uses users' personal information to:
- provide our services;
- track, confirm and fulfill Membership and other purchases;
- resolve disputes, collect fees, and troubleshoot problems;
- encourage safe trading and enforce our policies;
- customize, measure, and improve user experience and our services, content, and advertising;
- deliver targeted marketing, service updates, and promotional offers to you according to your preferences;
- perform other services for our users as described when AgBuySell collects the information.
- comply with legal obligations or a court order; or
- if this is necessary for the prevention, detection or prosecution of criminal offenses, such as fraud, deceit or prosecution, or
- if it is necessary to maintain our policies or to protect the rights and freedoms of others.
AgBuySell doesn't sell or rent users' personal information to third parties for their marketing purposes without users’ explicit consent. AgBuySell may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a posting or other content violates other's rights, or protect anyone's rights, property, or safety. It is not our policy or our practice to disclose or sell your personal information to any third party under any circumstances.
This website contains links to other sites that are not owned or controlled by AgBuySell, and these sites may likewise contain links to other websites. The owners and/or operators of these sites linked to and from AgBuySell.com are solely responsible for their practices and contents. Please be aware that AgBuySell is not responsible for the privacy practices of other sites. We cannot take any responsibility for the content of or the data protection and privacy practices of third-party websites. We hereby expressly distance ourselves from all conduct and content of any and all websites linked to the AgBuySell.com website.
We encourage you to be aware when you leave our website domain, and to read the privacy statements of each and every website that collects personally identifiable information. Our Privacy Policy applies only to information collected by AgBuySell.com.
If we decide to change our privacy policy, we will post those changes here so that you will always know what information we gather, how we might use that information, and whether we will disclose it to anyone. We advise you to read the policy regularly. Notable changes to this policy will be announced on our website. The amended policy will be effective immediately after posting. This Privacy Policy is effective January 1, 2018.

If you wish to place a new Listing for any item(s) agreeable with the AgBuySell User Agreement, you will need sufficient bid listings to participate.
A minimum of one (1) AgBuySell token is required to create 1 new Listing. You can purchase bid listings from your account. Each category of Listing will show the number of AgBuySell listings required to participate in any posting. Once you have opted to create a new Listing, the token(s) will be automatically deducted from your account balance.
Listings can be purchased at any time, and purchased listings* have NO expiration date!
For a limited time, AgBuySell will award 1 FREE token to any NEW Member upon completion and approval of registration. If the Member meets our qualifications, they will be awarded 1 free token with a 60 day expiration date.
Also, when a Member refers a new Member to the site, the referring Member will receive 1 FREE token upon the completion and approval of registration of the new Member. This new ‘referred’ Member will also receive 1 FREE token upon the completion and approval of registration. The free token will have a 60 day expiration date.
The expiration date will take effect 60 days after the date they are awarded. Free listings have no cash value, and cannot be returned, refunded or extended.
If for any reason a Member wishes to refund their listings, they can do so at any time. Only purchased listings are eligible for a refund. A 10% administration fee will be deducted from the total refund amount. This fee pays the cost for our staff to ensure your refund gets processed immediately.
There is a fee to post a service ad on agbuysell.com.
Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your province of residence, or that are not bought or sold in compliance with applicable laws and regulations. You are responsible for ensuring compliance with all applicable laws relating to the item you list, buy or sell.
Our Users expect to see information related to any ad posted on the AgBuySell website to be accurate and truthful, and we will all means to enforce this policy. AgBuySell uses preconfigured forms that collect data pertaining to each item in a specific Category.
We request that all fields be completed when posting any item for Auction, as this information is what our Buyers want to see before they can decide to place a bid, or have interest in purchasing your item(s). Accurate and comprehensive details will help Buyer satisfaction, reduce questions, and ensure you receive a good Feedback Rating once your Auction item(s) have been sold.
In addition to our general rules, you are expected to abide by the following Policies detailed below:
You must not use offensive language or profanities. AgBuySell may withdraw or alter an ad that contains inappropriate language or information.
Ads must not infringe third party intellectual property rights. Infringements include, but are not limited, to the following:
Copying and displaying a third party's logo, product description, photo either from another Seller's ad or from any other source. Any alleged infringements of the intellectual property rights of a third party will result in the removal of the ad from AgBuySell
The item must be described accurately and honestly in the ad.
The following activities are prohibited from AgBuySell Ltd and agbuysell.com, and will constitute a Violation of our AgBuySell User Agreement:
- Posting an Ad if you are not located in Canada
- Posting an item for sale that is not located in Canada
- Posting an ad that contains any false information pertaining to the item(s)
- Posting an item for sale that is illegal to own, buy or sell in your area of residence
- Posting an item for sale that is not in the allowed items list
- Posting duplicate Ads in multiple categories
- Posting Ads using multiple different email addresses and/or User Id's
- Posting an Ad that serves no other purpose other than to send traffic to a website
- Posting an ad containing a list of keywords not directly related to the item being sold
- Posting an Ad that contains adult, mature or erotic content. Personals are not allowed.
- Posting an Ad that defames anyone or contains "hate speech"
- Posting an Ad that contains offensive opinions, notices, or topics
- Posting deliberately misleading information
- Posting an Ad that may be related to any illegal activity
Any Ads that do not comply with the AgBuySell Ltd policy will be removed from the site. Additionally, Users that violate such Policies will be blocked from using agbuysell.com and all of our related companies and websites in the future.

If you are the winner of an Listing, you will be given the contact details of the Seller.

AgBuySell only brings the Seller and the Buyer together, and payment arrangements are left up to each of the parties involved.

Read the item description carefully. As a registered User, AgBuySell provides detailed information related to any Listing.
We make sure that our Sellers only provide accurate data pertaining to each and every Listing. If you have any additional questions about the item, you can get these answers by clicking on "Ask the Seller a Question” link. - Review the Seller's Feedback.
View the Seller's business reputation by looking at his or her Feedback score, and read the comments left by previous Buyers to be sure that this is a Seller you feel you can trust.
Both Buyers and Sellers are required to answer and submit a Feedback form that AgBuySell provides at the end of any completed Listing. - Bid or Buy It Now.
Check the item page to see what purchase options are available. You can either place a bid on an item or purchase it instantly using Buy It Now. Remember, all bids are active until the listing ends. If you win or click the Buy It Now button, you're obligated to complete the transaction. - Pay for the item.
After you've won or bought the item, make sure to contact the Seller and arrange your payment and/or delivery to the Seller within 3 business days. Failure to do so may result in a negative Feedback Rating, and cancellation of your AgBuySell Membership and/or account. If you're picking up the item, you can pay by any method the Seller accepts (including cash). - Shipping an Item:
AgBuySell integrates a Bid feature that enables Licensed Livestock Haulers to bid on completed cattle Listings. They will outline the cost, details, and the time line for pick up and delivery. This Listing will be posted to all Livestock Haulers who have an account in good standing with AgBuySell, and is an accredited Livestock transporter in Canada.
AgBuySell does not collect, represent, or manage any money as a result of a completed Listing. AgBuySell's mission and responsibility is only to bring Sellers and Buyers together. It is left up to the sole discretion of the Seller and Buyer to make any financial arrangements regarding the sale of any Listing item(s) on the AgBuySell website. Be sure to confirm all details of the Listing, and once you are satisfied with all the terms and conditions set out by the Seller, meet the required financial arrangements agreed upon. AgBuySell does not fall under any legislation or regulation in regards to Livestock dealership and it is up to the Buyers and Sellers to have all the required licensing and comply with all requirements required by law (including paying the appropriate fees and levies) not limited to the Livestock Identification and Commerce Act, the Marketing of Agricultural Products Act, and the Alberta Beef Producers Commission Regulation for the transaction of goods.

There are several different categories on the AgBuySell website that our Members use to find Listing items.
Each of these categories are specific to the type of animal(s) or item(s) you wish to post for sale: Purebred Cattle, Commercial Cattle, Dairy Cattle, Cattle Semen, Cattle Embryos, Land/Pasture Listings, Feed Listings, and Meat Listings.
The minimum cost to post any Listing is 1 token, and redeeming this token will post your Listing on the AgBuySell website for a total of 30 days. If your Listing item does not sell in that period, we will reclassify your Listing for a small 'reposting' fee.
AgBuySell does not collect money or represent payment on behalf of Sellers.
We offer several AgBuySell Token Packs tailored to meet your needs. An AgBuySell token is required to post any Listing, and the number of Tokens required to post multiple item Listings is posted below.
- 1-5 items in Listing: 1 token required
- 6- 20 items in Listing: 2 tokens required
- 21-50 items in Listing: 3 tokens required
- 51-100 items in Listing: 4 tokens required
- 101- 150 items in Listing: 5 tokens required
- 150 + items in Listing: 6 tokens required

The price per token for Listings will vary based on the Token Pack you choose. Listing tokens are available in packs of 5, 10, 20, 50, and 100 and cost $39.95 per token. The cost/number of tokens required for FULL Herd Dispersals will be calculated at the time of Listing.

AgBuySell's mission and responsibility is only to bring Sellers and Buyers together and to provide a forum for their exchange. It is left entirely up to the Seller and the Buyer to make any and all financial arrangements regarding the purchase and sale of any Listing item(s) on the AgBuySell website. As a Buyer, be sure to confirm all details of the Listing and, once you are satisfied with all of the terms and conditions set out by the Seller, be sure to meet the financial arrangements you and the Seller have agreed upon.

All completed Listings that require transport will be posted to the TRUCKERS BID BOARD immediately after the Buyer and Seller come to terms. Only BUYERS can elect to send a completed listing to the AgBuySell Transport module for bids.
As an accredited Trucker on the AgBuySell website, you will be able to post a bid to transport the contents of the completed Listing from the Seller to the Buyer. All Listing data including location, destination, loading & unloading specifics, # of head, average weights, distance, time line, etc will be available for you to make an accurate Bid to Transport.
Once the Buyer agrees to your price, you can make payment arrangements as you deem necessary.
